A motion is made by the defendants to

prefer this cause, and it is stated to be important for the interests of the city that a speedy trial be had. The summons and complaint were served on December 24,1902, and, thereafter, at least six several extensions of time within which to serve answers were obtained. On May 18, 1903, the answers were served with a notice of trial for the June term, and a further notice that a preference would be claimed and an application made to have the cause, set down for trial on June fifth.
