STAYTON, Chief Justice.
On May 26, 1889, appellants were in charge of and operating as receivers the Missouri, Kansas & Texas railway, which ran between Greenville and Jefferson, via Pittsburg,. They had a ticket office on the west side of the city of Greenville, and about one-half mile east of the business part of the city the railway controlled by them'crossed the St. Louis, Arkansas & Texas Railway track, but at the intersection there was neither depot building nor ticket office.
