Following a jury trial, the defendant, John Batinich, was convicted of committing the offense of delivery of a controlled substance (Ill. Rev. Stat. 1987, ch. 561/2, par. 1401(a)(2)) and was sentenced to a six-year term in the Department of Corrections.
