Appeal by the defendants, Joseph C. Conkling, individually and as administrator, etc., and others, from an interlocutory judgment of the Supreme Court in favor of the plaintiff, bearing date the 22d day of December, 1911, and entered in the office of the clerk of the county of New York upon the decision of the court, rendered after a trial at the New York Special Term, overruling the defendants’ demurrer to the complaint.

Ann Maria Miller died on the 4th day of September, 1893, seized in fee of certain real estate which the plaintiff in this action seeks to have charged with the payment of two deficiency judgments against an administrator of the said decedent, basing her right to that relief upon the following facts: The said decedent owned two leaseholds upon one of which she had given *41a mortgage on the 5th of September, 1889, to secure the payment of her bond for "the sum of $2,500 to one Matilda Wall.
