— There is no material difference between the parties in the statement of the terms of the contract. Appellants (defendants below) were under contract with the government of the United States to construct locks 4, 5, and 6 in the Warrior river, in this state. In *325the prosecution of this work, they required the services of a large number of men, wagons, and teams. There were some verbal negotiations between the contractors (defendants) and Patton & Loftin, which resulted in an arrangement which was afterwards reduced to writing in a letter from the contractors, addressed to Patton & Loftin,…
