Judgment unanimously modified on the law and as modified affirmed and matter remitted to Steuben County Court for resentencing in accordance with the following Memorandum: Defendant was convicted upon a jury verdict of criminal sale and criminal possession of a controlled substance in the third degree and sentenced to an indeterminate term of incarceration of 1 to 3 years. Defendant argues and the People concede that County Court erred in failing to impose sentence upon both counts of which defendant was convicted {see, CPL 380.20).
