SMYTH, Chief Justice.

This case, as observed by the majority, is to be determined by a correct interpretation of section 499 of our Code. It presents, therefore, but very. little difficulty, because the meaning of that section is as obvious and simple as the English language could well make it. It says that a deed of real estate shall take effect from the date of its delivery, “except that as to creditors and subsequent bona fide purchasers and mortgagees without notice of said deed, and others interested in said property, it shall only take effect from the time of its delivery to the recorder…
