Appeal from a judgment of Supreme Court, Erie County (Howe, J.), entered March 15, 2002, which determined that plaintiff was an employee of third-party defendant.

It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously affirmed without costs.
