ARNOLD, Justice.
Plaintiffs, all of whom were children of Charles G. and Mary Trent, both deceased, brought this action in the District Court of Lincoln County against P. J. Trent, a son of the deceased and brother of all the plaintiffs, and his wife Charlotte, and The Texas Company, alleging in their first cause of action that during his lifetime Charles G. Trent, their deceased father, was the owner and in possession of a certain described 40-acre tract in Lincoln County; that on November 16, 1945, Charles G.
