The action is to foreclose a second mortgage given by the Ithaca Street Railway Company, dated January 2, 1894. Prior to it is a first mortgage to defendant-respondent Farmers’ Loan and Trust Company, dated July 1, 1892.
The Ithaca Street Railway Company, when the mortgage in suit was executed, owned and operated an electric street railway in the city of Ithaca. The Cayuga Lake Electric Railway Company operated a line about two miles in length which was an extension of the line of the Ithaca Street Railway Company on Tioga street to Cayuga lake.
