We withdraw our previous opinion and judgment dated July 12, 2007 and issue the following opinion in its stead. See Tex.R. App. P. 50.

Appellant, Victor Lamont Mims, appeals from a jury verdict that found him guilty of murder. See Tex. Pen.Code Ann. § 19.02(b) (Vernon 2003). After the jury found him guilty as charged in the indictment, the trial court assessed his punishment at life imprisonment.
