*838On October 10, 2000 the infant plaintiff , then in the third grade, was injured during lunchtime recess when he fell from a flexible grid climbing device (hereinafter the cargo climber) on the school playground. The plaintiffs commenced the instant action against the defendant, Longwood Central School District (hereinafter the School District), alleging, inter alia, that the infant plaintiff was injured as a result of negligent supervision and a dangerous and defective condition in the cargo climber.
