The above-styled eases were filed seeking recovery of taxes alleged to have been erroneously assessed and collected by the Commissioner of Internal Revenue, hereinafter referred to as Commissioner. The actions were consolidated for the purpose of trial and tried before the Court without intervention of a jury. The action instituted by Kentucky Utilities Company, hereinafter referred to as K-U, presents five issues, one of which involves the deductibility of certain social security taxes.
