The defendant in error filed a motion to dismiss, in which it is contended that this court has no jurisdiction to entertain the writ of error: (1) because the principal sum in controversy was less than three hundred dollars, and the plaintiff in error did not appeal the judgment of the court overruling the motion for a new trial to the Appellate Division of the Civil Court of Fulton County before bringing his writ of error to this court, as is provided by law in such cases; and (2) because the bill of exceptions was not tendered to the trial judge within fifteen days from the date of the…
