The defendant Jerry Smith plead guilty to a charge of burglary. He was sentenced to a term of from 1 to 3 years by the Circuit Court of Henderson County.

The issues presented for review are whether the trial court erred in refusing to allow the defendant to withdraw a guilty plea which had been induced by the defense attorney’s erroneous representation that the defendant would receive probation and whether defendant should be permitted to plead anew because prior to accepting the guilty plea the trial court failed to determine that defendant understood the nature of the charge.
