Appeal from a judgment of the County Court of Broome County (Smith, J.), rendered March 21, 2002, convicting defendant upon his plea of guilty of the crimes of manslaughter in the second degree, vehicular manslaughter in the second degree and driving while intoxicated.

Defendant was charged in a three-count indictment with the crimes of manslaughter in the second degree, vehicular manslaughter in the second degree and driving while intoxicated following an automobile accident which resulted in the death of his female companion.
