*1192Appeal from an order of the Supreme Court, Niagara County (James B. Kane, Jr., J.H.O.), entered December 3, 2004 in a personal injury action. The order granted the motion of defendant Insulation Distributors, Inc. for summary judgment dismissing the amended complaint and cross claims against it.

It is hereby ordered that the order so appealed from be and the same hereby is unanimously affirmed without costs.
