The plaintiffs, as heirs at law of Robert Spence, sr., who died intestate in October, 1870, bring this action against the defendants, all of whom are heirs at law of said Robert Spence, sr., except the defendants, B. F. Brown and Sallie Y. Brown, for the partition and sale of a tract of land alleged to constitute a part of the real estate of said intestate.
