Appeal from an order of the Family Court of Chemung County (Hayden, J.), entered March 26, 1999, which dismissed petitioner’s application, in a proceeding pursuant to Family Court Act article 6, to modify a prior order of custody of the parties’ child.
The parties, who never married, are the parents of a five-year-old son. They separated after petitioner gave birth and the child remained with petitioner.
