The plaintiff "by this action seeks to impress a lien upon the sum of $4,363.63 claimed to have been collected by one Abraham Wolff and turned over by him to the defendant Ella Realty Co., Inc., as hereafter stated, on a policy of insurance issued by the Fidelity-Phenix Fire Insurance Company of New York for $7,500 upon the premises hereafter mentioned, which were destroyed by fire. Plaintiff is the assignee of the mortgage on the premises.
