—In an action, inter alia, to recover damages for breach of an oral agreement, the defendant appeals from a judgment of the Supreme Court, Kings County (Douglass, J.), dated January 17, 2002, which, upon a jury verdict, is in favor of the plaintiff and against him in the total sum of $2,177,646.80.
Ordered that the judgment is modified, on the law, by deleting the provision thereof awarding the plaintiff punitive damages in the sum of $100,000; as so modified, the judgment is affirmed, with costs to the plaintiff.
