This is an appeal from a judgment of $17,000 damages rendered against appellant for personal injuries.

Though several grounds of negligence were averred by the plaintiff, only one was submitted to the jury, and it alone need be stated in reciting the pleadings of the parties. Plaintiff alleged that on December 1, 1902, while in the employ of defendant as a switchman engaged in the operation of trains in its yards at Eagle Pass, he was, while attempting in the discharge of his duty to board one of its trains, thrown underneath by defendant’s negligence and his right leg…
