U respectfully concur in part and dissent in part. I agree with the majority in so far as it consolidates the appeal with the writ application and dismisses the appeal. Additionally, I agree with the majority’s finding that the trial court did not abuse its discretion in denying Pilot’s motion to dismiss for forum non conveniens. I disagree, however, with the majority’s denial of Pilot’s writ application seeking review of the trial court’s denial of its exception of prematurity and its motion to stay pending arbitration.
