— In a negligence action to recover damages for personal injuries, plaintiff appeals from a judgment of the Supreme Court, Nassau County (Robbins, J.), dated April 5,1982, which was in favor of defendant, upon a jury verdict, after a trial limited to the issue of liability. Judgment reversed, on the law, and new trial granted, with costs to abide the event. On Sunday, August 5, 1979, at approximately 12:30 p.m., the 50-year-old plaintiff was driving his moped in a northerly direction on South Franklin Street in Hempstead, New York.
