This is a suit brought by certain taxpayers owning lands in Eoad Improvement District No. 1 of Jefferson County against E. G. Goldsmith, a commissioner of the district, to recover from him certain amounts alleged to have been erroneously paid him for services as secretary of the hoard of commissioners, and for damages to his lands by the construction of the road, and certain other items.
The district was created by a special act of the 1921 General Assembly, and, upon the organization of the board of commissioners therein named, appellant was elected secretary and treasurer of the district.…
