This litigation began when Charles Golia (a distributor of malt beverages in the City of Arcade), James Palmer and George Waldrop (citizens, taxpayers, voters and consumers residing in the City of Arcade) filed an action in the Superior Court of Jackson County on behalf of themselves and others similarly situated seeking a judgment declaring the Uniform Beer Tax Act (Ga. L. 1974, p. 1447; Code Ann. § 58-706.1) to be unconstitutional and praying for an injunction against the enforcement of that Act.
