Reversing.

In the month of June, 1917, the appellant Robert B. Neely, shot, with a gun, and killed James. Strong, in Breathitt county. Thereafter, on July 3, Lula Strong, the widow of the deceased, and her children by a next friend, instituted this action against the appellant to recover damages for the death of the husband and father, as provided by section 4, Kentucky Statutes.
