Appeal from that part of an order of the Supreme Court (Spain, J.), entered December 20, 1994 in Albany County, which denied defendant’s cross motion for summary judgment dismissing the complaint.
Pursuant to its electrical work contract with the State, defendant purchased an "Owners and Contractors Protective” (hereinafter OCP) policy from Hanover Insurance Company (hereinafter Hanover), which áfforded the State coverage for bodily injury in the amount of $500,000 per occurrence.
