This is an action for the partition of certain property in the city of New York, of which one William Spread died seized on the 13th of January, 1826. His will, dated November 24, 1825, is as follows:

*124“ In the name of God, amen, I, William Spread, of the City of New York, being weak in body but of sound mind and memory, blessed be God for all His mercies, do this twenty-fourth day of November, in the year of our Lord one thousand eight hundred and twenty-five, make and constitute this my last will and testament in manner following, that is to say:
