Plaintiff and counterclaim defendant The Procter & Gamble Company, (“P & G”), commenced this action on January 20, 1994, alleging that defendant and counterclaim plaintiff Paragon Trade Brands, (“Paragon”), infringed two P & G patents, Lawson U.S. Patent No. 4,695,278 (the “Lawson” patent) and Dragoo U.S. Patent No. 4,795,454 (the “Dragoo” patent). Paragon answered and denied that its products infringe the Lawson and Dragoo patents and sought a declaratory judgment that these patents are invalid, unenforceable, and not infringed.
