On or about 8 March 2002, plaintiff-appellees (“plaintiffs”) filed their lawsuit against New Hanover County and the individually named defendant appellants (collectively “defendants”). Plaintiffs are persons who were employed at the New Hanover County Courthouse in Wilmington. Defendants operate and maintain the courthouse as required by the laws of this state. Plaintiffs allege in their complaint that they have been injured due to the presence of mold, carbon monoxide, and other chemicals and irritants in the building.
