Cross appeals from a judgment of the Supreme Court (Keniry, J.), entered February 15, 1991 in Albany County, which granted petitioner’s application, in a proceeding pursuant to CPLR article 78, to annul a determination of respondent finding that petitioner was in violation of City of Albany zoning ordinance.

For a number of years prior to 1989, petitioner conducted a law practice in a building owned by him at 314 State Street in the City of Albany. Petitioner at no time resided in that building. The building is located in an area zoned for residential use, but the zoning ordinance permits…
