A decree entered by the circuit court of Cook county construed the last will and testament of Charles A. Danz and ordered partition of his real estate. Margaret Kathryn Williams, a niece of the testator, prosecutes a direct appeal to this court, a freehold being involved.

Charles A. Danz, a resident of Cook county, died testate on October 18, 1937. He left surviving, Ida M. Danz, his widow, Albert J. Danz, a brother, and Margaret Kathryn Williams, the only child of his deceased brother, John Danz, as his only heirs-at-law. The only son of Albert J. Danz is Edward J. Danz, who has nine minor…
