Appeal from the Appellate Court for the Third District;— heard in that court on appeal from the Circuit Court of McLean county; the Hon. Owen T. Reeves, Judge, presiding. The following is the opinion of the Appellate Court, filed at the time of rendering the judgment upon which this appeal is prosecuted: Wall, P. J.: “In the year 1887, Lowentrout & Shausten were sub-contractors, under one Eager, in the building of a portion of the Lake Erie and Western railroad.
