Appeal by une defendant, The National Life Association of Hartford, Connecticut, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Orleans on the 10th day of March, 1898, upon the decision of the court rendered after a trial at the Orleans Special Term.

McLennan, J.:
Two questions are presented by this appeal:
First. Did the rights of the plaintiff and of the insured, under the policy in question, cease and terminate because of the failure of '-the insured to pay the bi-monthly premium at the home office of the • defendant before twelve o’clock, noon, of the 1st day of August, 1895, and because the defendant immediately thereafter notified the ' insured that for that reason said policy was forfeited, and had been •declared void by it ?
Second. If the policy was not forfeited by reason of such failure ■to pay, and the declaration of forfeiture…
