This was an action begun before a justice of tbe peace in Warren County against tbe Southern Railway Company and Seaboard Air Line Railway Company for tbe penalty for unreasonable delay in transportation of goods shipped 22 January, 1907, from High Point, N. 0., on tbe line of tbe former road, and delivered to the consignee, tbe plaintiff, at Warrenton, a station on tbe last-named road, 14 February, 1907.
