A. E. Mims and others have prosecuted an appeal to this court from an order denying them a temporary writ of injunction to restrain the city .of Fort Worth and its executive officers from enforcing a city ordinance, No. 1736, requiring the payment of a license fee for the privilege of selling farm products within the corporate limits of the city. The temporary writ of injunction sought was ancillary to a suit to permanently enjoin the enforcement of that ordinance, principally on the ground that it was in violation of the provisions of the state and Federal Constitutions.
