An increasing number of guardianship petitions and actions to terminate parental rights so as to freenhildren in foster care for adoption are being brought to the Family Court. When contested, they present a clash between the assertion of parental rights as traditionally maintained and the assertion of the rights of children in terms of what is set forth as in their best interest.
