This suit (to recover damages for the breach of a contract to sell land) was sev*819ered in the trial court from a multi-claim suit for damages. R. J. Anderson, the purchaser under the terms of an alleged sales contract, instituted the original suit as plaintiff. Defendants originally named were Archie Melady, Ed Melady, individually and as independent executor of the estate of Leola Melady, deceased, and Joe Frobese, temporary administrator of the estate of Leola Melady, deceased.
