CROSS, District Judge.
The controversy in this suit is over the use of the word “Solar” as a trade-mark for a baking powder. The case has already been before Judge Gray, of this circuit, upon exceptions to the answer, and his opinion thereon may be found reported in 130 Fed. 726. A summary of the pleadings in the case made by that learned judge, will be found in his opinion and need not be here repeated.
