SANDSTROM, Justice.

Jim and Kim Raboin appealed from a judgment of the district court affirming the North Dakota Department of Human Services’ (the Department) finding of probable cause to indicate child abuse by the Raboins in disciplining their children. We conclude there is a statutory right of appeal to the courts from the Department’s finding of probable cause to believe child abuse or neglect is indicated. We also conclude the Department’s finding of probable cause is not supported by a preponderance of the evidence and is not in accordance with the law, and we reverse and remand to…
