This case was before the court in Wilson & Co. v. Fremont Cake & Meal Co., D. C. Neb., 77 F.Supp. 364, 380, which sets out, with clarity and detail adequate for present purposes, the nature of the action and the posture of the pleadings up to the date of that ruling.
