On January 18, 1996; Defendant, Mr. Dale F. Svaeina, was indicted on two counts: (I) possession with the intent to distribute more than 100 grams of a substance containing methamphetamine, relating to a transaction on August • 22, 1995; and (II) attempt to possess with the intent to distribute more than 100 grams of a substance containing methamphetamine, relating to a transaction on November 3,1995. Pursuant to a written plea agreement, Count I was dismissed and Defendant'pled guilty to Count II. Defendant was sentenced on September 16, 1996, to a term of 163 months…
