The appellant, as plaintiff, sued the appellees, as defendants, on an arbitration bond, in the court below.

In his complaint, the appellant alleged, in substance, that on the 24th day of June, 1874, the appellees Henry and Albert W. Bash agreed with the appellant to submit to Jehu Swaidner, Calvin B. Richards and "William W.
