I. Facts and Procedural History

The instant matter stems from an automobile accident, one occurring on December 29, 2010, in which defendant *363Raymond Leuthy (hereinafter “defendant”) allegedly rear-ended a vehicle driven by plaintiff Thomas Kelleh and occupied by plaintiff Ellen Woods (hereinafter “plaintiff Kelleh,” “plaintiff Woods,” or jointly “plaintiffs.”).
