Appeal by the defendant, The Webber Construction Company, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of' Kings on the 27th day of December, 1911, upon the verdict of a jury for $10,500, and also from two orders entered in said clerk’s office on the 28th and 29th days of December, 1911, respectively, denying the defendant’s motions for a new trial made upon the minutes.

Stapleton, J.:
This is an appeal from a judgment entered upon a verdict rendered in favor of the plaintiff, and from an order denying a motion, made upon the minutes, to set aside the verdict and for a new trial.
The action was brought to recover damages, for personal injuries. The plaintiff was a servant and the defendant his master. The casualty occurred on November 24, 1909. The complaint pleaded négligence according to the principles of the common law. It also alleged compliance with article 14 of chapter 36 of the Laws of 1909, being the Labor Law (Consol. Laws, chap. 31).
