Plaintiff in error (hereafter called defendant) was indicted at the November, 1922, term of the McLean county circuit court for a violation of the Illinois Prohibition act. The indictment contained two counts. The first count charged defendant with unlawfully having in his possession intoxicating liquor containing more than one-half of one per cent of alcohol by volume. The second count charged him with unlawfully selling intoxicating liquor containing more than one-half of one per cent of alcohol by volume.
