DAVIDSON, Presiding Judge.
Appellant was convicted of theft from the person, his punishment being assessed at two years confinement in the penitentiary.
The record discloses that the alleged owner, Paul Rodgers, had been picking cotton in Coleman County; that his residence was in Scurry County, five miles west of Snyder; that enroute home from Coleman County he stopped at Abilene, in Taylor County, and spent the day.
