Appeal from St. Louis City Circuit Court. — Hon. James E. Withrow, Judge. (1) The court erred in refusing to give an instruction as to the testimony of an accomplice. The word “accomplice” means simply a participator in crime, and at common law it included all the particeps criminis, whether principals in the first or second degree, or accessories. Russ. Trial was had in the circuit court of the city of St. Louis, Missouri, resulting in defendant’s conviction and his punishment being assessed at two years in the penitentiary.
