I. BACKGROUND
Presently before the Court is the United States of America’s Motion to Set Aside Order of Remand (Docket No. 36), filed on October 14, 2009. To date, that motion remains unopposed. Therein, the United States argues that the Court improperly remanded this case, which the United States had previously removed from state court. Specifically, the United States asserts that the Court should not have remanded the case sua sponte for failure to comply with a procedural requirement for removal, namely the thirty day period for removal…
